Discount HeatingAs owner, I do not have to refresh my leagally rent of tenants in the decomposition of our heating and hot water

Our heating was interrupted for 10 days now. We have done everything to rectify the problem had a cycle engineer, on 5 occasions. On 3 occasions the company had brought the wrong party. Our tenant does not pay rent during this period. What could we do?

Legal is a matter for the state to settle in court. As owner, you have contracted the tenant to provide housing in exchange for rent. Most courts agree that the housing includes a heating system operating, even if the tenant must pay for fuel. This is not your fault that tenants heating has gone wrong and this is certainly not the fault of tenants that you hired a competent engineer to fix or at least aggravate the problem. I can not conceive of a civil court under the English common law (all colonies) are siding with the tenant in this case. If you use your heart and listen to what is morally right, you know what the answer is correct.

You should not matter to you if it's a legal problem?

You want to tell us that you own and you do not know the laws on this ?????? Not very bright are you ?????? I do not blame the tenants for a bit, is you responsibilty to maintain this kind of thing does not belong to them. I do not want you as the owner thats for sure.

You need to update the rent. If it was 10 days, it's terrible. Just to be nice, I'd at least half price for the number of days during which they have no heating or hot water.

They are entitled to a discount. They pay for the apartment and related services. If the contract says that you provide hot water and for some reason you fail to provide legally, you do not keep your end of the operation.

Since your tenants are not homeless, and they can still live on the premises, they can not demand any payment at all, but they are entitled to an equitable reduction.

I understand your situation. You've done all the right things, but your tenants will not heat for 10 days.

If you like the tenants and what they are, I offer
$ 100 dollars from their rent vouchers they can use whenever they then want. This way is December and they have to buy gifts for their children, they will have an extra $ 100.

This is probably not legally binding, but it's the right thing to do.

Let's put it that way, if you were the tenant, and you had no heat or hot water, would you pay a full rent without two things you need every day? The situation is acute, and it seems that you try, but it was 10 days, and the reality is that you own the property. The tenant has a cliam legal, but morally the right thing to do is give them at least a rent reduction for the inconvenience. While they are still living without heat and hot water, make a prorated for each day they live without heating and hot water to deduct half the daily amount of rent.
